You agree to defend, indemnify, and hold harmless the Controller, its licensees, and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms, specifically including any claim arising from your provision of a phone number that is not your own.
For U.S. Residents: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in accordance with the Federal Arbitration Act. You adhere to waive your right to a jury trial or to participate as a plaintiff or class member in any purported class action lawsuit.
Corporate Jurisdiction: Without prejudice to mandatory consumer protection laws applicable in the United States, these Terms shall be governed by the laws of Germany, where the Controller is established.
Any arbitration shall be conducted on an individual basis only, and not as a class, consolidated, collective, or representative action.
The Service is controlled, operated, and administered by the Controller from our offices within Germany but is targeted exclusively at users located within the United States. If you access the Service from a location outside the United States, you are responsible for compliance with all local laws.
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination.
